Zdążę app terms of use

This is an English translation provided for convenience. In case of any discrepancy, the Polish version prevails.

§1. General provisions

  1. These terms of use (“the Terms”) set out the rules for using the Zdążę mobile application (“the App”), available for iOS and Android.
  2. The App is provided and published by Aleksander Kowalski, running a business under the name Byte Solutions, tax ID (NIP): 6112831525, REGON: 527536920 (“the Provider”).
  3. Contact with the Provider: [email protected].
  4. The App is an independent, unofficial tool that presents publicly available data on timetables and vehicle positions of public transport in Legnica. The App is not published, operated or endorsed by MPK Legnica sp. z o.o. or by the Municipality of Legnica.

§2. Conditions of use

  1. The App is available free of charge for iOS and Android devices.
  2. Using the App requires no registration and no account.
  3. The App needs an active internet connection and, depending on the features used, access to the device’s location and permission to send push notifications.
  4. By using the App, the user confirms that they have read these Terms and the Privacy policy and accept them.

§3. Data sources

  1. Timetable and vehicle position data shown in the App comes from the open dataset published by the Municipality of Legnica (opendata.legnica.eu) in the GTFS/GTFS-Realtime format, made available free of charge and used in line with that portal’s terms of use.
  2. Map data comes from the OpenStreetMap project and is available under the Open Database License (ODbL): © OpenStreetMap contributors.
  3. The App downloads data on an ongoing basis, at reasonable intervals, in a way that neither disrupts nor overloads the services it uses.

§4. Limitation of liability

  1. The Provider does not guarantee that the data shown in the App is up to date, complete or accurate, because it comes from external sources independent of the Provider.
  2. The App is used at the user’s own risk.
  3. The Provider is not liable for any damage, including in particular missing a vehicle, resulting from using the App or from errors, delays or unavailability of the source data.
  4. The availability of the App and its features depends on the availability of the external services it uses (in particular gtfs.legnica.eu and the map tile provider) and may be temporarily interrupted for reasons beyond the Provider’s control.
  5. The Provider reserves the right to suspend the App temporarily for maintenance or for reasons beyond its control, without prior notice.

§5. Intellectual property

  1. The App’s name, visual design, source code and content created by the Provider are the Provider’s property and are protected by copyright, except for the data referred to in §3, which is made available under separate licences.
  2. Names and trademarks of third parties mentioned in the App (including “MPK Legnica”) belong to their owners and are used for information purposes only, without suggesting any affiliation with or endorsement by those parties.
  3. Copying, modifying or distributing the App’s source code or graphic elements without the Provider’s prior consent is prohibited.

§6. Complaints

  1. Complaints and reports about the App can be sent to [email protected].
  2. A complaint should include a description of the problem and contact details for the reply.
  3. The Provider handles complaints within 14 days of receiving them.

§7. Final provisions

  1. The Provider reserves the right to change these Terms. Users will be informed of significant changes by publication of a new version of the Terms, with its update date, on zdaze.pl and in the App’s descriptions in the App Store and Google Play.
  2. Continuing to use the App after the changes take effect means accepting them.
  3. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code.
  4. These Terms take effect on the day of publication.
